“You"/"your"/"seller"/"user" refers to the customer/vendor/owner/advertiser of property.
“Us"/"we"/"our" refers to MoveWise.co.uk Ltd
“Service" refers to the process of online marketing/advertising of the customer’s property.
“Conditions" refers to these terms and conditions.
“Fee"/"charge" refers to sums payable in respect of the service.
“Content" refers to all data, either written or photographic required for the service.
1. Acceptance of Terms and Conditions:
By using the service as provided by the website MoveWise.co.uk, the user agrees to these terms and conditions.
2. Policy:
It is the policy of MoveWise.co.uk to carry out a service that is fair, accurate and credible to all of its customers.
3. Consent:
In agreeing to our terms and conditions and using our service, you confirm your compliance with the following statements:
3.1 You are the legal owner of the property with the sole right to sell. Alternatively, you have the legal right via power of attorney to act on behalf of the property owner.
3.2 You will agree to provide details that are TRUTHFUL and ACCURATE, thus ensuring that any material listed about your property is not misleading in ANY way.
3.3 You give consent to MoveWise.co.uk to advertise your property details.
3.4 You require the details of your property to be advertised immediately after receipt of payment to MoveWise.co.uk
3.5 You give your consent to be contacted by MoveWise.co.uk to enable us to notify you of buyer interest and/or MoveWise.co.uk originated information.
3.6 You have confirmed the details and implications of any existing contract that you may or may not have with any other interested party, e.g., an estate agent.
3.7 You will only publish the details of one property per each paid listing.
4. Privacy Statement:
All of our customer’s personal details are protected via our secure database. Only those details that you require to be published with fall within the public domain. We adhere to the data protection act and will NOT share any of your information with any other party. No information that is held by our customers will be imparted or sold to any other party. 5. Cancellation:
If for ANY reason you decide that you do not require the services of MoveWise.co.uk within the period of 24hours after the online payment is placed; we offer a FULL refund of your advertising fee. This cancellation notification must be sent via email, and received during the initial 24 hours. After the period of 24 hours has expired, our refund policy comes into effect, (see refund policy). The exception to this is when a customer of MoveWise.co.uk receives an enquiry via our service into their account, within the initial 24-hour period, and in this case a refund is not due as the service has been used irreversibly.
6. Refunds:
6.1 Each case for a refund request will be taken on its own merit, and we will provide either full or partial refunds when there is an issue that we cannot solve or rectify. However, under no circumstances, will our liability exceed the value of the advertising fee paid by the customer.
6.2 There will be no refund of advertising fees paid on the grounds that there is a temporary or permanent loss of service in any circumstance.
6.3 Any request for a refund should be written either on email or letter. You may also, of course, wish to request a refund verbally.
7. Accuracy & Liability:
7.1 MoveWise.co.uk are not responsible for the accuracy of those details and images listed in reference to each property. This responsibility lies solely with the customer, and it is a requirement of our customers to give TRUTHFUL and ACCURATE details about their property listing. We cannot be liable for any inaccuracies that may lie within any listing.
7.2 It is imperative that property details are CORRECT as MoveWise.co.uk reserve the right to remove and/or amend the details given by our customers if we deem them to be false or misleading to visitors to our website.
7.3 MoveWise.co.uk will regularly check all property listings, and amendments may be made to correct any errors that may have occurred.
7.4 MoveWise.co.uk cannot accept liability for faults or errors to property listings on our partner sites, e.g. Fish4 Homes etc. We will, however, ensure that any problem is rectified in a timely manner from the time when it has been brought to our attention.
7.5 There are no circumstances in which our liability will exceed that of the advertising fee paid by the customer.
8. For Sale Boards:
8.1 Our professionally produced For Sale Boards should reach you with 5 working days and are free with the Mayfair package. Should you wish to add your own telephone number, or add an 0870 contact number to the board, this will incur an additional cost.
8.2 If it the case that a For Sale Board arrives in a faulty condition, or displays incorrect information, a replacement board will be sent out. A replacement will not be given for accidental damage; however, a new For Sale Board can be purchased in this instance.
8.3 It is the responsibility of the customer to check with their local authority for policies/restrictions relating to the display of the For Sale Board.
9. Pricing Structure
9.1 All prices shown on this website are accurate. They are inclusive of VAT and there are no hidden extra costs. MoveWise.co.uk reserve the right to alter or change any pricing or the content of our packages at any time without any prior notice.
9.2 We have taken great steps to ensure that our pricing is competitive within this marketplace, and are extremely confident that our website, service and strategies serve our customers to the highest standard.
10. Customer Responsibilities:
10.1 The customer is responsible for paying for the advertisement in full before the advert will be published.
10.2 If you have a contractual agreement with an estate agent or any other party, you are solely responsible for adhering to the terms within this. MoveWise.co.uk will not be responsible for any breach of such a contract.
10.3 The customer is responsible for setting the for sale price for their property. MoveWise.co.uk have no part in this decision.
10.4 The customer is required to arrange and conduct the viewings themselves for their advertised property.
10.5 The customer agrees to contact MoveWise.co.uk to advise them of any changes to the status of their property, e.g. sold or taken off the market. This will enable potential buyers to have accurate information about the property, and will also stop any unnecessary interest.
10.6 MoveWise.co.uk is a website that solely deals with residential property, and therefore, the customer is prohibited from advertising any other form of property.
11.0 MoveWise.co.uk responsibilities:
11.1 We will endeavour to supply a For Sale Board within 5 working days of receipt of payment for your listing. This is subject to postal delays that would be out of our control, e.g. postal strike.
11.2 The property listing will appear on the MoveWise.co.uk website within 24 hours of a customer entering their property details. The property listing will appear on our partner sites, e.g. Fish4homes within an approximate timeframe of 48 hours; however, we cannot guarantee this due to it being with a third party.
11.3 All necessary steps have been taken to ensure that the MoveWise.co.uk website is up and running 24 hours a day, 365 days per year. Any updates that may be required will be undertaken with the minimum amount of disruption possible and as such we reserve the right to take the site offline to accommodate this.
11.4 We will response to all enquiries within a timely manner, and in most cases all queries will be responded to within 24 hours.
11.5 The price charged to use our service is allocated towards the set up cost of each advertisement and the administration associated with this. Therefore, after a customer’s property has been listed on our site and/or partner sites for a period of 24hours, the service has been fully delivered. The advertising of the listing will remain in place after this point on a free of charge basis.
11.6 The publication of the properties on our partner sites is potentially subject to amendment or cancellation without notice. This is due to the fact that the partner sites may impose changes, and as such we cannot guarantee unlimited publication with them.
12. Complaints:
12.1 We pride ourselves in a high level of customer service and treat all of our customers in a fair and honest way. Occasionally, things can go wrong and we would request that you contact us and give us the opportunity to put things right.
